# Terms of Service — InkConscious

## 1. Acceptance

Use of IC Studio, IC Design, or related APIs means acceptance of these Terms and the Privacy Policy. **B2B** service for tattoo professionals (**18+**), not for end clients getting tattoos.

## 2. Definitions

- **Studio:** account holder on IC Studio.  
- **End-customer:** person contacting the studio (WhatsApp, Instagram, forms).  
- **Standalone IC Design:** device registered without a studio account.  
- **Linked IC Design:** use with studio credentials.

## 3. Account and security

The studio is responsible for its users and credentials. No sharing session tokens with unauthorized third parties. We may suspend for abuse, non-payment, or illegality.

**Security logs (all studios):** to protect the platform, prevent fraud, and defend software intellectual property, InkConscious automatically records technical usage data (e.g. IP address, device/browser type, API endpoints accessed, session timestamps, legal acceptance records). This data is **not sold** and is **not** used for advertising. See the Privacy Policy (security section).

## 4. Plans and pricing (indicative)

- **Mobile (iOS/Android):** subscriptions via **Apple/Google IAP**; manage in the store.  
- **Web/Windows:** **Stripe** on inkconscius.eu unless otherwise agreed.  
- Auto-renewal unless cancelled before period end.  
- No prorated refunds except as required by law or documented billing error.

Indirect taxes (e.g. **IGIC** in Canary Islands) per applicable invoicing.

## 5. AI services

See **AI Terms** (`ai-terms`). Summary: OpenAI or equivalents; BYOK allowed; platform usage limits or pay-as-you-go; output not medical/legal advice.

## 6. End-customer data

The **studio** is controller. InkConscious is **processor** (DPA). `/consent-form/` is studio-operated; InkConscious is not a healthcare provider.

## 7. Meta channels (WhatsApp / Instagram)

See **Channel Connector Terms** (`channel-connector`). Studio authorizes connection and complies with Meta policies.

## 8. Intellectual property and prohibited use

Studio content (designs, photos, client texts) remains the studio’s. **InkConscious / IC Studio / IC Design software, code, UI, brand, and documentation** are the exclusive property of the provider (Valerio Zanzarelli).

**License:** limited, non-exclusive, non-transferable, revocable use for the subscribing studio’s internal operations.

**Expressly prohibited** without written authorization:

- Copying, cloning, reproducing, or creating derivative works of the software (in whole or in part).
- Reverse engineering, decompilation, or extraction of source code.
- Screenshots, screen recordings, or exports intended to recreate the product or build competing software.
- Sharing credentials, tokens, or captures with third parties (developers, agencies) for copying purposes.
- Reselling, sublicensing, or redistributing the service.

Breach may result in immediate account suspension and legal action under applicable Spanish law.

## 9. Availability and liability

**Best effort** service. Not liable for Meta, OpenAI, store, or force majeure outages. Liability cap: fees paid by the studio in the prior **12 months**, except fraud or gross negligence.

## 10. Termination

User may delete account (Privacy). We may terminate with notice or immediately for material breach.

## 11. Governing law and venue

**Spanish law.** B2B disputes: courts in **Spain**, preferably **Canary Islands** residence of the provider unless mandatory law provides otherwise.  
**US B2B customers:** same terms unless a signed agreement states otherwise.

## 12. Incorporated documents

Privacy Policy, DPA (`dpa-studio`), Sub-processors, Acceptable Use, AI Terms, Channel Connector, SLA.

## 13. Changes

New version published on use or notice; material changes may require in-app acceptance.
